The company SMILEAT S.L. (hereinafter, the "Organizer"), with registered office at Calle Gran Vía 62, 5ª Derecha 28013 - Madrid (Spain) and with NIF number B-87144622, launches a promotional action for the Smileat brand of products, which will be governed in accordance with the following legal bases:

1. FIELD

Temporary

The promotional period will be from June 9, 2025 to August 31, 2025, inclusive.

• Territorial

The territorial scope of the promotion comprises the Spanish State.

• Participants

Only individuals over 18 years of age with legal residence in Spain who have accepted and comply with all the terms and conditions set forth in these terms and conditions may participate in this promotion.

Each consumer may participate a maximum of three (3) times per day, each participation with a different promotional code, which will be found on the pack of the promoted products described in section 1.4; and provided that he/she complies with the established conditions.

Participation is free of charge and is limited to three (3) per day per person per email.

In case a consumer registers more than once during the promotional period, he/she must indicate the same personal data in each registration. Otherwise, it will be understood that their data are not correct and the Organizer may exclude the participant from the promotion.

Participation is forbidden to all those persons linked professionally or professionally with the Organizer, their direct relatives, as well as the Organizer's collaborators directly or indirectly involved in the development or implementation of this promotion.

• Product included in the promotion

The promoted products, the purchase of which allows participation in this promotion, are all Smileat brand products marked with the promotional code on-pack.

• Purchasing establishments

Participation in this promotion is limited to purchases of the promoted products made in physical and online stores in Spain.

2. AWARDS

The distribution of the prizes will be carried out by means of the "Winning Moments" computer system, according to the mechanics detailed in clause 3 of these rules.

There will be a total of twenty (20) prizes throughout the promotion. Each prize consists of a reimbursement of Smileat products, up to a maximum of three hundred euros (€300) reimbursed.

2.1. Conditions of the awards

The Organizer will send an email to each winner with a unique code and instructions to request a refund of up to three hundred euros (€300) in Smileat products through the form provided for this purpose from July 1, 2025 until December 31, 2025. After this date, no more refunds can be requested and the Organizer will not be held responsible for the amount of refunds not requested by the winners.

The prizes contained in this promotion, in no case may be subject to change, alteration or financial compensation at the request of the winners.

The prizes are personal and non-transferable. The waiver of the prize will not entitle the waiveror to any indemnity or compensation whatsoever.

The effective delivery of the prize will be conditioned to the winner's compliance with the conditions specified in these rules and the veracity of the data provided.

Prizes are limited to one per person, email and bank/Bizum account.

If for any reason beyond the Organizer's control the prizes are not available, the Organizer reserves the right to substitute them for others of similar characteristics and of equal or greater value.

The deadline for the winner to claim the prize that corresponds to him/her will expire thirty days after the end of the promotion, provided that he/she complies with all the requirements established in these rules. The claim may be made via email to: [email protected].

The prizes of the present promotion will be subject to the regulations in force regarding Personal Income Tax (I.R.P.F.), and in accordance with the same, the participants are informed that the prizes awarded for the participation in games, contests, raffles, or random combinations, whether or not linked to the offer, promotion or sale of certain goods, products or services, are subject to withholding or payment on account provided that the value of the prize is greater than 300 Euros in cash or 250 Euros in kind. The winner will be responsible for any fiscal or tax charges that the acceptance of the prize may entail, as well as any other expenses arising from the promotion that are not expressly assumed by the Organizer in these Rules.

3. MECHANICS OF PARTICIPATION IN THE PROMOTION

All those who during the promotional period purchase a promoted product marked with the on-pack promotional code will be able to access during the same period through the website https://www.smileat.com/pages/tarrito-doradoand fill in the registration form provided for this purpose with all the mandatory data requested.

Each code will represent only one participation. In case of more than one participation with the same code, participants will be excluded from the promotion.

The claims period ends thirty days after the end of the promotion.

3.1. Winning Moment Mechanics

The distribution of prizes through the Winning Moments computer system will be carried out according to the following mechanics:

• Participants will know if their entry has been matched with a Winning Moment at the time of entry after submitting the form by clicking on the "Enter" button.
• Users who participate in the promotion and match a Winning Moment will receive one of the prizes described in these terms and conditions.
• For each Winning Moment there will be an exact day, hour and minutes. The Winning Moments will be determined completely randomly by a computer application and the list will be generated prior to the start of the promotion.
• In the event that a Winning Moment does not coincide with the participation of any user, the prize will be awarded to the first person who participates after the determined Winning Moment. If at the end of the promotion no participation has been registered between the Winning Moment and the end of the promotion, the prize will be declared void and the Organizer may dispose of the prize as it sees fit.
• In the event that the participant, or the participation corresponding to a Winning Moment does not comply with the conditions set forth in these rules, the participant will lose the right to the prize, and the Organizer may dispose of it as it sees fit and, if appropriate, offer it to the alternate winner who will be the next participation in ascending order.

3.2. Communication with the winners

After verifying the winning entry, the Organizer will send the participant an email, to the email address provided in his/her registration, confirming the status of his/her participation, providing the winning code and the instructions for claiming the prize.

In the event that the winner renounces the prize, has not complied with the requirements set forth in these rules, or the information provided is inaccurate, incorrect or insufficient, the winner will lose the right to the prize and the prize will be forfeited and made available to the Organizer.

The Organizer is not responsible for the possible non-receipt of the e-mail by the winner.

4. IMAGE RIGHTS OF THE WINNERS

The winners authorize the Organizer to reproduce and use their name and surname and other data, as well as their image, in social networks of the brand or any promotional activity related to the promotion in which they have won, without such use conferring any right of remuneration or benefit except for the delivery of the prize won.

5. PROTECTION OF PERSONAL DATA

In accordance with the provisions of the current regulations on personal data protection, Regulation (EU) 2016/679 (GDPR) and the Organic Law on Data Protection and Guarantee of Digital Rights (ES) 3/2018 (LOPDGDD), we inform you that the data included in the registration form will be included in a file whose responsible is the Organizer, in order to manage your participation in the promotion. By participating in the promotion you expressly consent to the processing of your data in order to count on your participation.

The legitimacy to process personal data is the explicit consent given by the user through the completion of the participation form provided for this purpose. Your data will only be stored for the duration of the promotion. However, your data will be kept as long as it is necessary to comply with the purposes foreseen, as well as with the legislation in force.

Likewise, by checking the box (not pre-checked) included in the registration form, the participant expressly consents to the processing of his/her data for the purpose of sending commercial and advertising information about the Organizer's products and/or services by post, e-mail, SMS, or any other equivalent means of electronic communication.

We inform you that all fields marked with an asterisk (*) in the registration form must be completed, so that the omission of any of them could prevent your participation in the promotion and / or obtaining the prize, if any, as well as any communication with you. Participants in the promotion undertake to inform the Organizer of any modification of their personal data so that they are updated at all times and do not contain errors.

We inform you that you may exercise your rights of access, rectification and deletion (right to be forgotten), limitation of data, data portability and opposition, by sending a letter to the Organizer or email to [email protected]. The Organizer undertakes to treat at all times your personal data as absolutely confidential and in accordance with the purposes set out in this clause and will take the necessary technical and organizational measures to ensure the security of your data and avoid its alteration, loss, unauthorized access or processing, given the state of technology, the nature of the data stored and the risks to which they are exposed, all in compliance with the provisions of the Regulation.

Finally, we inform you that you can file a complaint with the supervisory authority, the Spanish Data Protection Agency (AEPD), through its website: www.aepd.es.

6. RESERVATIONS AND LIMITATIONS

The Organizer is exonerated from any liability in case of malfunction of electronic communication networks that prevent the normal development of the promotion for reasons beyond their control and especially for external acts of bad faith. Nor will they be responsible for transmission problems or loss of data not attributable to them.

The participant may be asked for a written document accepting all the terms and conditions of the promotion, as well as his/her ID (or any other valid document proving his/her identity) and the original product pack with the printed code; it must match exactly with the data registered in his/her participation. In case the participant does not send the requested documentation within 72 hours or the data does not match the data registered in his/her participation, the Organizer reserves the right to disqualify his/her participation.

The conservation of the product pack, its shipping and forwarding is under the sole responsibility of the participant and once sent, the Organizer will be responsible for the document. The participant must keep the original product pack containing the promotional code until one month after the end of the promotion.

The Organizer reserves the right to cancel and even withdraw the prize automatically and without explanation of any kind, to those users whose participations do not meet the mandatory data requested or whose data were erroneous, as well as users who are misusing the promotion: perform fraudulent acts, harm other participants or are suspected of impeding the normal development of the promotion; without the affected users can claim to the Organizer for the disqualification of their participations and the Organizer may exercise all the corresponding civil or criminal actions.

The Organizer is exempt from any liability in the event of any error in the data provided by the participants themselves that would prevent their identification and the delivery of the prize.

Any abusive or fraudulent use of the website by users will result in the consequent disqualification of the participant in the promotion. If the improper use of the website (with or without fraudulent intent) causes the malfunction of the website, the Organizer will be exonerated from all responsibility and may cancel the promotion.

Likewise, it shall be understood, by way of example but not limitation, that abuse or fraud occurs when a participant registers using a false identity or identities of third parties without their consent.

The Organizer is not responsible for possible losses, deterioration, delays or any other circumstance attributable to third parties that may affect the participation in this promotion.

The Organizer reserves the right to make changes that result in the success of the promotion when there is just cause or force majeure that prevents it from being carried out in the manner set forth in these rules.

The Organizer reserves the right to make changes or add subsequent annexes to the mechanics and prizes of this promotion as long as they are justified or do not harm the participants, and are duly communicated to them.

In the event that this promotion cannot be carried out, either due to fraud, technical errors, or any other reason beyond the control of the Organizer that affects the normal development of the promotion, the Organizer reserves the right to cancel, modify, or suspend the promotion, without the participants being able to demand any responsibility from the Organizer.

Both the products promoted in general, as well as any of their specific references, may not be permanently or temporarily available in some specific points of sale. The Organizer is not responsible for the impossibility of finding the promoted products or any of their references in the specific points of sale.

The sole responsible for the organization of the promotion is the Organizer and the participants acknowledge that the distribution companies or establishments where the products of the brand object of the promotion are marketed, are totally alien to the realization of the promotion, renouncing to demand any type of responsibility in relation to the execution of the promotion.

7. ACCEPTANCE OF THE TERMS AND CONDITIONS

Participation in the promotion implies full acceptance of these rules and the express submission of the interpretative decisions made by the Organizer.

8. APPLICABLE LAW AND CONSULTATION OF THE BASES

This promotion is governed by current Spanish legislation.
